Information about the privacy policy of the company: „Komin-Flex” Sp. z o.o. and information obligation towards owners of personal data.

  1. The administrator of your personal data is „Komin-Flex” Sp. z o.o., (hereinafter: Administrator), e-mail address rodo@kominflex.com.pl;
  2. From 25 May 2018, in relation to the Regulation of the European Parliament and of the Council(EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data, and repealing Directive 95/46/EC, hereinafter referred to as RODO, the legal basis for the processing of personal data at „Komin-Flex” Sp. z o.o. is:
    • 6(1)(b) of the RODO in relation to data necessary for the performance of contracts to which data subjects are parties,
    • 6(1)(c) RODO in relation to data necessary to fulfil the legal obligation of „Komin-Flex” Sp. z o.o. resulting from applicable laws, including tax and accounting regulations,
    • 6(1)(f) of the RODO in relation to data the processing of which is necessary for purposes resulting from the legitimate interests of „Komin-Flex” Sp. z o.o., i.e. for the purpose of a possible claim or defence against claims, as well as for the purpose of directing marketing information concerning „Komin-Flex” Sp. z o.o. products to customers in the course of performing contracts concluded with them,
    • (1)(a) RODO in relation to data the provision of which is not obligatory, processed on the basis of the data subject’s consent, i.e. for the purpose of sending marketing information about the products of „Komin-Flex” Sp. z o.o.to potential customers or former customers, after the execution of contracts concluded with the customers.
  3. „Komin-Flex” Sp. z o.o. will transfer your personal data to postal operators or couriers delivering products to customers, banks in the execution of payments, entities providing services for “Komin-Flex” Sp. z o.o. regarding its IT system and legal services, as well as at the request of services and authorities entitled to receive personal data on the basis of applicable laws.
  4. Your personal data will be processed at „Komin-Flex” Sp. z o.o. for the duration of the contract and the period until the expiry of the limitation period in which possible claims may be raised from the contract indicated by the provisions of the Civil Code (i.e. Journal of Laws 2017.459). If such claims are raised, the period for processing personal data will be extended by the period for asserting the claim or defending against the claim. However, the period for processing your personal data shall not be shorter than the period for archiving sales evidence required by accounting regulations.
    As regards personal data processed in „Komin-Flex” Sp. z o.o. for the purpose of sending marketing information to you, as referred to in point 2 d) of this document, i.e. before or after concluding an agreement, they will be processed until you withdraw your consent or object to such processing. You may withdraw your consent at any time by sending an e-mail to rodo@kominflex.com.pl or by post to the Administrator’s address. Withdrawal of consent will not affect the lawfulness of processing carried out on the basis of consent given before its withdrawal.
  5. With regard to your personal data processed by „Komin-Flex” Sp. z o.o., you have the right:
    1. request from the Administrator confirmation as to whether or not personal data are being processed and, if this is the case, obtain the information referred to in Article 15(1) of the RODO, i.e.
      • the purposes of the processing;
      • categories of personal data concerned information on the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
      • where possible, the intended period for which the personal data will be stored and, where this is not possible, the criteria for determining that period;
      • information on the right to request the administrator to rectify, erase or restrict the processing of personal data concerning the data subject, and to object to such processing;
      • information on the right to lodge a complaint with a supervisory authority;
      • if the personal data have not been collected from the data subject, any available information as to their source;
      • information on automated decision-making, including profiling as referred to in Article 22(1) and (4), and, at least in those cases, relevant information on the modalities of the decision-making, as well as on the significance and the envisaged consequences of such processing for the data subject;
    2. request access to your personal data, rectification, immediate erasure or restriction of processing,
    3. object to the processing of personal data,
    4. file a complaint with the supervisory authority PUODO with its registered office in Warsaw, ul. Stawki 2, if you believe that the processing of personal data in „Komin-Flex” Sp. z o.o. violates the provisions of law,
    5. receive your personal data in a commonly used electronic machine-readable format (e.g. CSV), allowing it to be sent to another administrator, or request direct transmission to another administrator, if technically possible.
  6. Providing personal data of „Komin-Flex” Sp. z o.o. is a condition for the conclusion and performance of the contract. Failure to provide such data makes it impossible to conclude and perform the contract. Providing personal data, the processing of which requires the consent of the person concerned, is not mandatory and their nonfeasance does not have any consequences.
  7. „Komin-Flex” Sp. z o.o. does not process data in an automated form, including profiling.

 

Processing of personal data provided by the data subject (contact form).

  1. The basis for the processing of personal data is the consent of the data subject (Article 6(1)(a) of the RODO1).
  2. The purpose of data processing is to contact you and to answer the questions you have submitted in the contact form.
  3. The personal data provided will be stored by the Administrator for the time required to perform the tasks indicated in point 2. This is without prejudice to situations in which applicable laws impose an obligation to store personal data for a longer period.

  6. Recipients of personal data are state institutions authorised by law.
  7. Personal data will not be transferred to a third country/international organisation.
  8. The data subject may request a copy of the data from the Administrator.
  9. The data subject has the right to withdraw consent to processing at any time. The withdrawal of the consent does not affect the lawfulness of data processing prior to the moment consent was withdrawn.
  10. The data subject has the right to object to the processing of their personal data and to lodge a complaint with the supervisory authority.
  11. The data subject has the right to request access to the personal data, rectification, erasure, as well as restriction of processing and portability of the personal data.
  12. The provision of data is not mandatory, is not a statutory or contractual requirement.
  13. Failure to provide the data will make it impossible for the Administrator to contact you back and to take actions related to responding to the enquiry submitted via the contact form.
  14. Data will not be used to make automated decisions in individual cases, including profiling.
